Ten Thirty One Exchange Transactions, Inc. serves taxpayers nationwide as a qualified intermediary for Internal Revenue Code Section 1031 "like-kind" property exchanges. Section 1031 states that "... No gain or loss shall be recognized on the exchange of property held for productive use in a trade or business or for investment if such such property is exchanged solely for property of like-kind which is to be held either for productive use in a trade or business or for investment."

To qualify as a 1031 exchange, the taxpayer cannot have "constructive receipt" of the proceeds of the sale, and a "qualified intermediary" is necessary. As a qualified intermediary, our role is to hold the proceeds of the sale and to buy the replacement property on behalf of the taxpayer. We prepare all the documentation necessary to easily understand the transaction and to clearly identify each party's role and responsibility.
